Copyright and Limitations on Use |

Trading & Investment Tools disclaims all warranties, express or implied,
including without limitation, implied warranties of merchantability, fitness for
a particular purpose, or non-infringement. Hoadley Trading & Investment Tools
does not warrant that the web site will operate or perform in a manner that is
uninterrupted or error-free, or that the web site, host server, or downloadable
software and spreadsheets will be maintained free of viruses or other harmful
code. Hoadley Trading & Investment Tools makes no warranties that the
information presented on the web site is current, up-to-date, or
accurate.
Under no circumstances and
regardless of legal theory, whether in tort, contract or otherwise, will Hoadley
Trading & Investment Tools be liable to you or any other party for an
indirect, special, incidental, reliance, or consequential damages, however
caused, and regardless of character, including without limitation, any damages
relating to lost data, computer failure or malfunctioning, or otherwise.

In order to provide a low
cost quality service to all users, use of this web site is subject to a
reasonable usage policy. This is to ensure that no user is unfairly
disadvantaged by the behaviour of other users. Examples of unreasonable usage
include downloading the same version of software multiple times from this web
site, or continually using on-line calculators where downloadable software would
provide the same or similar functionality.
Hoadley Trading &
Investment Tools reserves the right to determine reasonable usage on a
case-by-case basis and to prevent access to all or part of this web site where
usage is considered to be unreasonable. You agree to this reasonable usage
policy in relation to your use of the web site.
In order to provide products and tools free of
charge or at a competitive price, technical product support is
subject to a reasonable support request policy as defined in this
section.
Each purchase of the full version of the Finance Add-in for Excel
will include an entitlement to three support incidents. An incident is defined as a single issue
or question that focuses on one area of the Finance Add-in for Excel or
Excel spreadsheet application downloaded from this web site. If a
support incident is found to be due to a bug in the Hoadley software,
the incident will not be counted towards the three allowable incidents.
After three incidents support will still be available if the support
requests are considered by Hoadley Trading & Investment tools to fall
within the definition of reasonable as defined below.
Support for all incidents will
be limited to helping users with issues or questions which
Hoadley Trading & Investment Tools considers are not
adequately covered by the following resources: web site product
description pages; FAQs; on-line tutorials; embedded help notes and help sheets in
Excel applications; the Finance Add-in for Excel help-file
function reference, and function sample work sheets. Support will not be
provided in cases where Hoadley Trading & Investment Tools
considers an experienced Excel user could resolve an
issue by simply examining cell formulas or VBA code, or by
observing how the product performs using the supplied examples or the
user's own data.
The Options Strategy Evaluation Tool (OSET) is a free download
from this web site and is made available on an "as is" basis without
a support entitlement. Support will
be provided to users of OSET if the support requests are considered to be reasonable.
Financial advice or help in applying the tools to specific user
investment or trading situations will not be provided under any
circumstances.
Hoadley Trading & Investment Tools reserves the right to
determine whether or not requests for technical support are
reasonable on a case by case basis and will not respond to support requests which it considers to be too frequent,
or to requests which fall outside the above reasonable technical support guidelines. You
agree to this Technical Support Policy in relation to your use of
products and tools downloaded from this web site.

Technical support will be provided in accordance with the Technical Support
Policy in place at the time support is requested.
Software purchased and/or downloaded on-line through the Hoadley Trading & Investment
Tools website is considered to have been opened at the time of purchase and in keeping with
industry standards, opened software cannot be returned. The extensive
product descriptions, 20+ on-line tutorials and demos, the free version
of the Options Strategy Evaluation Tool and the free trial of the
Finance Add-in for Excel, which includes full documentation and samples
of all functions, should be used by prospective buyers to evaluate the
products to ensure that they meet their needs before
purchasing.
Refunds are not possible once a product has been purchased and/or downloaded. Making a purchase and/or downloading software from
this web site indicates your acceptance of this policy.
